Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Mikhael Studio Michał Stefański ("IdleArc", "we", "us", or "our") and govern your use of the IdleArc game, the idlearc.com website, and related services (together, the "Services"). By creating an account, downloading, or playing IdleArc, you agree to these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy explains how we handle your personal data — please read it. It is a separate document, not part of these Terms, and we may update it as described there. In-game behavior is additionally governed by our Code of Conduct, which is part of these Terms.

You must be at least 13 years old (or the higher minimum age required in your country, such as 16 in parts of the EEA) to use the Services. If you are a minor under the laws of your country, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Parents and guardians are responsible for purchases made by minors in their care.

Health notice. A small percentage of people may experience seizures or discomfort when exposed to flashing lights or patterns, including in video games — sometimes without any prior history. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing immediately and seek medical advice if you experience dizziness, altered vision, twitching, disorientation, or convulsions. Take regular breaks and play in a well-lit room.

• You need an account to play. You agree to provide accurate information and to keep your login credentials confidential.
• You are responsible for all activity that happens on your account. Tell us promptly at [email protected] if you suspect unauthorized access.
• Accounts are personal. You may not sell, rent, share, gift, or transfer your account, or buy or use someone else's account.
• You may delete your account at any time in the app's settings. Deletion is permanent and removes your progress, characters, and virtual items (see Section 5 and our Privacy Policy).

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play IdleArc on devices you own or control, for your private, non-commercial entertainment. This license exists only as long as these Terms allow, and does not give you any ownership of the game, its content, or your account.

You may not (except where the law expressly permits it): copy, modify, or distribute the game or its content; reverse-engineer or decompile the game; extract assets or data; exploit the Services commercially; or interfere with the operation or security of the Services.

IdleArc is an online game shared with other players. When using the Services you must follow our Code of Conduct. In particular, you may not:

• Cheat — IdleArc is an idle game, and letting the game play itself through the game's own systems is the point; anything beyond that is cheating. You may not use auto-clickers, auto-tappers, macros, bots, scripts, modified or unofficial clients, private servers, or any tool that automates input or plays the game for you; tamper with the app, its memory, its network traffic, or your device clock to manipulate timers, boosts, or rewards; access the Services other than through the official app, or scrape or data-mine them; or exploit bugs, glitches, or unintended mechanics for advantage (if you find a bug, report it instead of abusing it). Please also play one account at a time — creating extra accounts to farm guild contributions, leaderboards, or events counts as cheating;
• Engage in real-money trading — buying or selling accounts, items, currency, or services for real money outside official in-app purchases;
• Harass, threaten, or abuse other players, or post unlawful, hateful, or sexually explicit content in chat, usernames, guild names, or anywhere else in the game;
• Impersonate other players or IdleArc staff, or spread scams and phishing;
• Attack, probe, overload, or otherwise interfere with our servers and infrastructure, or access them other than through the official app.

We may investigate violations and take any action we consider appropriate, including warnings, removing content, adjusting or removing illegitimately gained progress or items, muting, and temporarily or permanently suspending accounts (see Section 10).

IdleArc contains virtual currencies (for example Arcstone, gold, and rubies) and virtual items (for example equipment, pets, runes, skins, and boosts) — together, "Virtual Items". Virtual Items:

• are licensed to you, not sold — you receive a limited license to use them within the game under these Terms, and you do not own them;
• have no real-world monetary value, cannot be exchanged for real money or anything of value outside the game, and are not refundable except as required by law or the applicable app store's policies;
• may change as the game evolves — we adjust stats, appearance, availability, and drop rates for valid reasons: game balance, fairness between players, technical and security needs, and legal requirements. If a change would significantly reduce the usefulness of Virtual Items you bought with real money, Section 6 (notice and your rights) applies;
• are tied to your account. They are removed permanently when you delete your account. If we permanently ban your account for a serious or repeated breach of these Terms, you lose access to Virtual Items; this does not affect any statutory rights you have — for example regarding recently purchased and unused virtual currency — and you can always contest a ban (Section 10).

IdleArc is a live, seasonal game. You acknowledge and agree that:

• Seasons end. Seasonal characters, seasonal progress, seasonal guild progress, leaderboards, and season-specific content are reset or archived when a season ends, by design. Certain account-level progress and purchases designated as permanent carry across seasons as described in the game.
• The game evolves. We continuously balance, add, change, and remove content, features, classes, items, and mechanics. Balance changes may affect Virtual Items you obtained or purchased.
• Online service. The game requires an internet connection and our servers. We may perform maintenance, and we may modify, suspend, or discontinue all or part of the Services. If we permanently discontinue IdleArc, we will give reasonable advance notice where practicable.
• Your rights when we change things. If a change (other than the seasonal resets described above) significantly worsens your access to or use of the game or things you have paid for, we will notify you in advance in the app or by email. If you are a consumer in the EU/EEA, you may then terminate your contract with us free of charge within 30 days of the notice or the change (whichever is later), as provided by law.
• Events and promotions. We regularly run in-game events, promotions, and occasional contests or giveaways. Each may have its own additional rules, shown where the event appears; those rules apply alongside these Terms. Event rewards are Virtual Items (Section 5) unless the event rules say otherwise. We may adjust or end an event early if it malfunctions or is being exploited — rewards already fairly earned will be honored.
• Experimental features. We sometimes ship beta or test features — including new seasonal mechanics — that are clearly experimental. These may change, break, or disappear without notice, and progress or rewards tied to them may be adjusted if they don't work as intended. We appreciate bug reports on them more than anywhere else.

• In-app purchases (such as Arcstone packs and IdleArc Premium) are processed by the app store you use — Apple App Store or Google Play — under that store's own terms and payment systems. We never receive your payment card details.
• Subscriptions (such as IdleArc Premium) renew automatically until cancelled. You can manage or cancel a subscription at any time in your App Store or Google Play subscription settings; cancellation takes effect at the end of the current billing period.
• Refunds are handled by the app store under its refund policies. We cannot directly issue refunds for store-processed purchases, but statutory consumer rights that apply to you remain unaffected.
• EU/EEA withdrawal right: EU law gives consumers a 14-day right of withdrawal for digital purchases. For digital content, that right normally ends early once delivery begins — but only with your express consent and acknowledgement, which Apple or Google collects in their purchase flow. Withdrawal and refund requests for store purchases are handled by Apple or Google under their processes. Nothing in these Terms limits your statutory withdrawal or refund rights, including for anything you buy inside the game with Arcstone.
• Unauthorized purchases: if a purchase was made on your account without your permission — including by a child using your device — contact the app store first (Apple and Google handle refunds for unauthorized purchases directly), and let us know at [email protected] so we can help secure your account. Please don't dispute purchases you actually made with your bank: chargebacks on legitimate, consumed purchases may lead to the purchased items being removed and, in repeat cases, account suspension.
• Subscription price changes: we may change the price of a subscription for future billing periods for valid reasons (such as increased costs or expanded content). You will get clear advance notice, and — depending on your app store — the change either requires your agreement or gives you time to cancel before it applies.
• Prices, pack contents, and availability may change at any time; changes do not affect purchases already completed.
• Purchasing does not exempt an account from these Terms — accounts that violate them may be actioned regardless of purchase history.

The Services let you submit content such as chat messages, usernames, guild names, and descriptions ("User Content"). You keep any rights you have in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and moderate it as needed to operate the Services. You are responsible for your User Content; it must comply with Section 4 and applicable law. We may remove or modify User Content that violates these Terms, and we are not obliged to monitor it.

Your ideas. We love hearing feature ideas and balance feedback — on Discord, by email, or in-game. So we can actually use them, you agree we may freely use any ideas or suggestions you share, without restriction, credit, or compensation, and that they don't create any confidentiality obligation. If we build something you suggested, that's the game getting better — it doesn't give you rights in it.

The Services — including the game client, server software, artwork, characters, names, logos, music, text, and all other content (except your User Content) — are owned by us or our licensors and are protected by copyright, trademark, and other laws. All rights not expressly granted to you in these Terms are reserved.

We may suspend or permanently terminate your account, restrict features (such as chat), or remove Virtual Items if you materially or repeatedly violate these Terms or the Code of Conduct, if required by law, or to protect the Services and other players. Where reasonable, we will apply the least severe appropriate measure and tell you the reason; automated anti-cheat flags are reviewed by a person before any significant action is taken.

You may stop using the Services and delete your account at any time. Upon termination for any reason, your license under Section 3 ends and access to Virtual Items is lost. Your statutory rights — including any refund rights under mandatory consumer law for purchases you were unable to use — remain unaffected.

The Services rely on and may link to third-party services — such as the Apple App Store, Google Play, sign-in providers (Google, Apple), and our community Discord server. Those services have their own terms and privacy policies, which we do not control and for which we are not responsible.

We work hard to keep IdleArc fun, available, and bug-free, but the Services are provided "as is" and "as available". To the extent permitted by law, we make no warranties — express or implied — about availability, uninterrupted or error-free operation, or fitness for a particular purpose. This does not limit any statutory warranties or guarantees that consumer law in your country provides and that cannot be excluded (including, for EU/EEA consumers, the legal guarantee of conformity for digital content and services).

Nothing in these Terms excludes or limits our liability for intentional misconduct or gross negligence, for death or personal injury caused by our negligence, or for anything else that cannot be excluded or limited under applicable law.

Subject to the above, we are liable only for damages that are a foreseeable result of our breach of these Terms, and our total liability in connection with the Services is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, and (b) EUR 50. We are not liable for indirect or consequential losses such as loss of data, progress, or Virtual Items caused by events outside our reasonable control.

Claims caused by you. If a third party brings a claim against us because of content you posted or something unlawful you did while using the Services, you agree to compensate us for damages and reasonable costs we incur as a direct result — except to the extent we contributed to the problem. This doesn't apply to ordinary gameplay or anything we did wrong.

If you are a consumer, the limitations above apply only to the extent the law of your country allows liability to be limited by agreement. They do not limit our liability under mandatory consumer-protection law — including the legal guarantee of conformity for digital content and services — and they never apply to the situations listed in the first paragraph.

We may update these Terms for these reasons: changes in law or regulator guidance; new or changed features, content, or business models; security, fraud-prevention, or technical needs; or fixing errors and improving clarity. For material changes, we will give you reasonable advance notice (for example in the app or by email) before the new Terms take effect. If you continue using the Services after the effective date, the updated Terms apply to you. If you do not agree with a change, you may stop using the Services and delete your account before the change takes effect.

Changes are not retroactive: they do not affect purchases already completed or rights you have already acquired.

These Terms are governed by the laws of Poland. If you are a consumer, this choice does not take away the protection of any mandatory consumer laws of the country where you live — those always apply to you as well — and where the law of your country gives you the right to bring or defend proceedings in your local courts (as it does across the EU/EEA and UK), nothing in these Terms takes that right away.

If you have a problem, please contact us first at [email protected] — most issues can be resolved quickly and informally. EU consumers may also be able to use local out-of-court consumer dispute resolution bodies.

Extra terms for players in the United States.

• California: IdleArc is provided by Mikhael Studio Michał Stefański, Pod Sosenkę 14, 32-061 Rybna, Poland. Charges are shown in the app before you buy. If you have a complaint, contact us at [email protected]; you may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, phone 1-800-952-5210.
• New Jersey: our disclaimers and liability limits (Sections 12–13) are not intended to limit rights you have under the New Jersey Consumer Fraud Act, Products Liability Act, Punitive Damages Act, or UCC, and apply to you only to the extent New Jersey law allows.
• Copyright complaints: if you believe content in IdleArc (including something another player posted) infringes your copyright, email [email protected] with a description of the work, where it appears, your contact details, and a good-faith statement that the use is unauthorized. We remove infringing content and may suspend repeat infringers.

The license to the IdleArc app you download from the App Store is governed by Apple's standard Licensed Application End User License Agreement; these Terms govern your account and the online service. If you downloaded IdleArc from the Apple App Store, the following also applies:

• These Terms are between you and us only — not with Apple, and we, not Apple, are solely responsible for the app and its content.
• Your license is limited to use on Apple-branded devices that you own or control, as permitted by the App Store's Usage Rules — except that the app may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
• We, not Apple, are solely responsible for any maintenance and support of the app, as described in these Terms or required by law; Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are our responsibility.
• Apple is not responsible for addressing any claims relating to the app, including product liability claims, legal or regulatory compliance claims, consumer protection claims, and claims under privacy or similar legislation; and, in case of third-party claims that the app infringes intellectual property rights, we — not Apple — are responsible for their investigation, defense, settlement, and discharge.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
• Questions, complaints, or claims about the app should be directed to us using the details in Section 18.
• You must also comply with any applicable third-party terms (for example, your wireless data agreement) when using the app.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision is replaced by a valid one that comes closest to its purpose. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the Services who assumes our obligations. These Terms, together with the Code of Conduct, are the entire agreement between you and us regarding the Services.

Survival. Sections that by their nature should outlive your account — including Sections 5 (Virtual Items), 8 (User Content), 9 (Intellectual Property), 12–13 (Disclaimers and Liability), 15 (Governing Law), and this Section 17 — remain in effect after your account is deleted or terminated.

Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control — for example internet or hosting outages, actions of app stores or other third-party providers, natural disasters, war, or government action. We'll do our best to restore the Services promptly.

How we contact each other. We may send notices in the app, on idlearc.com, on our Discord server, or by email to your account address — please keep it current. Legal notices to us go to [email protected] or the postal address in Section 18. A notice is considered given when posted in the app or on the website, or when the email is sent.

Language. These Terms are published in English and Polish. If you are a consumer in Poland, the Polish version is the binding one for you. We may add convenience translations in other game languages over time; if a translation conflicts with the English version, the English version applies — unless mandatory language rules in your country say otherwise.
