Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Mikhael Studio Michał Stefański ("IdleArc", "we", "us", or "our") and govern your use of the IdleArc game, the idlearc.com website, and related services (together, the "Services"). By creating an account, downloading, or playing IdleArc, you agree to these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy explains how we handle your personal data — please read it. It is a separate document, not part of these Terms, and we may update it as described there. In-game behavior is additionally governed by our Code of Conduct, which is part of these Terms.

1. Who Can Play

You must be at least 13 years old (or the higher minimum age required in your country, such as 16 in parts of the EEA) to use the Services. If you are a minor under the laws of your country, you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Parents and guardians are responsible for purchases made by minors in their care.

Health notice. A small percentage of people may experience seizures or discomfort when exposed to flashing lights or patterns, including in video games — sometimes without any prior history. If you or anyone in your family has an epileptic condition, consult a doctor before playing. Stop playing immediately and seek medical advice if you experience dizziness, altered vision, twitching, disorientation, or convulsions. Take regular breaks and play in a well-lit room.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and play IdleArc on devices you own or control, for your private, non-commercial entertainment. This license exists only as long as these Terms allow, and does not give you any ownership of the game, its content, or your account.

You may not (except where the law expressly permits it): copy, modify, or distribute the game or its content; reverse-engineer or decompile the game; extract assets or data; exploit the Services commercially; or interfere with the operation or security of the Services.

4. Code of Conduct and Fair Play

IdleArc is an online game shared with other players. When using the Services you must follow our Code of Conduct. In particular, you may not:

We may investigate violations and take any action we consider appropriate, including warnings, removing content, adjusting or removing illegitimately gained progress or items, muting, and temporarily or permanently suspending accounts (see Section 10).

IdleArc contains virtual currencies (for example Arcstone, gold, and rubies) and virtual items (for example equipment, pets, runes, skins, and boosts) — together, "Virtual Items". Virtual Items:

The Services let you submit content such as chat messages, usernames, guild names, and descriptions ("User Content"). You keep any rights you have in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and moderate it as needed to operate the Services. You are responsible for your User Content; it must comply with Section 4 and applicable law. We may remove or modify User Content that violates these Terms, and we are not obliged to monitor it.

Your ideas. We love hearing feature ideas and balance feedback — on Discord, by email, or in-game. So we can actually use them, you agree we may freely use any ideas or suggestions you share, without restriction, credit, or compensation, and that they don't create any confidentiality obligation. If we build something you suggested, that's the game getting better — it doesn't give you rights in it.

9. Intellectual Property

The Services — including the game client, server software, artwork, characters, names, logos, music, text, and all other content (except your User Content) — are owned by us or our licensors and are protected by copyright, trademark, and other laws. All rights not expressly granted to you in these Terms are reserved.

10. Suspension and Termination

We may suspend or permanently terminate your account, restrict features (such as chat), or remove Virtual Items if you materially or repeatedly violate these Terms or the Code of Conduct, if required by law, or to protect the Services and other players. Where reasonable, we will apply the least severe appropriate measure and tell you the reason; automated anti-cheat flags are reviewed by a person before any significant action is taken.

You may stop using the Services and delete your account at any time. Upon termination for any reason, your license under Section 3 ends and access to Virtual Items is lost. Your statutory rights — including any refund rights under mandatory consumer law for purchases you were unable to use — remain unaffected.

11. Third-Party Services

The Services rely on and may link to third-party services — such as the Apple App Store, Google Play, sign-in providers (Google, Apple), and our community Discord server. Those services have their own terms and privacy policies, which we do not control and for which we are not responsible.

12. Disclaimers

We work hard to keep IdleArc fun, available, and bug-free, but the Services are provided "as is" and "as available". To the extent permitted by law, we make no warranties — express or implied — about availability, uninterrupted or error-free operation, or fitness for a particular purpose. This does not limit any statutory warranties or guarantees that consumer law in your country provides and that cannot be excluded (including, for EU/EEA consumers, the legal guarantee of conformity for digital content and services).

13. Limitation of Liability

Nothing in these Terms excludes or limits our liability for intentional misconduct or gross negligence, for death or personal injury caused by our negligence, or for anything else that cannot be excluded or limited under applicable law.

Subject to the above, we are liable only for damages that are a foreseeable result of our breach of these Terms, and our total liability in connection with the Services is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the event giving rise to the claim, and (b) EUR 50. We are not liable for indirect or consequential losses such as loss of data, progress, or Virtual Items caused by events outside our reasonable control.

Claims caused by you. If a third party brings a claim against us because of content you posted or something unlawful you did while using the Services, you agree to compensate us for damages and reasonable costs we incur as a direct result — except to the extent we contributed to the problem. This doesn't apply to ordinary gameplay or anything we did wrong.

If you are a consumer, the limitations above apply only to the extent the law of your country allows liability to be limited by agreement. They do not limit our liability under mandatory consumer-protection law — including the legal guarantee of conformity for digital content and services — and they never apply to the situations listed in the first paragraph.

14. Changes to These Terms

We may update these Terms for these reasons: changes in law or regulator guidance; new or changed features, content, or business models; security, fraud-prevention, or technical needs; or fixing errors and improving clarity. For material changes, we will give you reasonable advance notice (for example in the app or by email) before the new Terms take effect. If you continue using the Services after the effective date, the updated Terms apply to you. If you do not agree with a change, you may stop using the Services and delete your account before the change takes effect.

Changes are not retroactive: they do not affect purchases already completed or rights you have already acquired.

15. Governing Law and Disputes

These Terms are governed by the laws of Poland. If you are a consumer, this choice does not take away the protection of any mandatory consumer laws of the country where you live — those always apply to you as well — and where the law of your country gives you the right to bring or defend proceedings in your local courts (as it does across the EU/EEA and UK), nothing in these Terms takes that right away.

If you have a problem, please contact us first at [email protected] — most issues can be resolved quickly and informally. EU consumers may also be able to use local out-of-court consumer dispute resolution bodies.

16. Apple App Store — Additional Terms

The license to the IdleArc app you download from the App Store is governed by Apple's standard Licensed Application End User License Agreement; these Terms govern your account and the online service. If you downloaded IdleArc from the Apple App Store, the following also applies:

17. Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision is replaced by a valid one that comes closest to its purpose. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of the Services who assumes our obligations. These Terms, together with the Code of Conduct, are the entire agreement between you and us regarding the Services.

Survival. Sections that by their nature should outlive your account — including Sections 5 (Virtual Items), 8 (User Content), 9 (Intellectual Property), 12–13 (Disclaimers and Liability), 15 (Governing Law), and this Section 17 — remain in effect after your account is deleted or terminated.

Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control — for example internet or hosting outages, actions of app stores or other third-party providers, natural disasters, war, or government action. We'll do our best to restore the Services promptly.

How we contact each other. We may send notices in the app, on idlearc.com, on our Discord server, or by email to your account address — please keep it current. Legal notices to us go to [email protected] or the postal address in Section 18. A notice is considered given when posted in the app or on the website, or when the email is sent.

Language. These Terms are published in English and Polish. If you are a consumer in Poland, the Polish version is the binding one for you. We may add convenience translations in other game languages over time; if a translation conflicts with the English version, the English version applies — unless mandatory language rules in your country say otherwise.
